Rules for the “Creative Time with Buch&Co.” Contest

Participation inthe “Kreativzeit mit Buch&Co.”sweepstakesorganized byKolibri 360 GmbH, headquartered in Cologne, with a business address at Industriestraße 23, 70565 Stuttgart, Germany (hereinafter referred to as“Kolibri360”), is only permitted in accordance with these Terms and Conditions. By participating in the sweepstakes, you accept the following terms and conditions.

1. Eligibility Requirements

All natural persons with legal capacity who are at least 18 years of age at the time of participation and who have their permanent residence in Germany, Luxembourg, Austria, or Switzerland are eligible to participate (hereinafter“Participants”). In Austria, only consumers are eligible to participate. Employees of Kolibri360 and their family members are excluded from participation.

Each participant may enter the contest only once.

Participation in the contest is not contingent on the purchase of products or the use of other services offered by Kolibri360.

The deadline for entry isNovember 15, 2026,at12:00 a.m. To be consideredon time, the solution must be submitted to the email address gewinnspiel@kolibri360.de by the deadline.

Legal recourse is excluded.

2. Early Termination and Disqualification from the Contest

Kolibri360 reserves the right to cancel the contest in whole or in part. This applies in particular if the contest cannot proceed as planned for any reason, such as computer viruses, software and/or hardware errors, and/or other technical and/or legal reasons that affect the administration, security, integrity, and/or the regular and proper conduct of the contest.

Kolibri360 also reserves the right to exclude individuals who violate these terms and conditions, use unauthorized aids, or otherwise gain an advantage through manipulation.

3. Profit

"Creative Time with Buch&Co." gift sets will be given away in a drawing. Each participant may win only one gift set.

It will be decided by drawing lots.

The prize cannot be transferred to a third party. Cash payment of the prize is not available.

Winners will be notified by email. By entering the contest, participants agree that, if they win, their name and place of residence may be published or shared for processing purposes.

The prize will be sent by mail.

4. Liability

Claims for damages in connection with the conduct of the sweepstakes are excluded, unless otherwise specified below. The foregoing disclaimer of liability also applies in favor of the legal representatives and vicarious agents of Kolibri360, should you assert claims against them. Excluded from the aforementioned disclaimer of liability are claims for damages resulting from injury to life, limb, or health, as well as claims for damages arising from a breach of material contractual obligations. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract. Also excluded from the disclaimer of liability is liability for damages resulting from an intentional or grossly negligent breach of duty by Kolibri360, its legal representatives, or vicarious agents.

Furthermore, Kolibri360 shall not be liable for damages resulting from the interruption of the availability of the email address gewinnspiel@kolibri360.de due to technical malfunctions beyond its control, events of force majeure, or attacks by third parties on the email account. However, Kolibri360 will make every effort to ensure the reliability and functionality of the email account. Furthermore, Kolibri360 does not guarantee that the email address will function properly on your device.

5. Data Protection

As part of your participation in this contest, Kolibri360 also processes information about you in accordance with its privacy policy. Kolibri360 processes your data exclusively in accordance with the applicable data protection requirements set forth in the EU General Data Protection Regulation 2016/679 and other applicable data protection regulations. In doing so, Kolibri360 ensures the protection of your personal data, in particular through technical and organizational security measures that comply with current security standards.

Kolibri360 processes and stores your data for the purpose of fulfilling the contest agreement with you in accordance with Article 6(1), sentence 1, subparagraph (b) of the GDPR.

6. Jurisdiction / Governing Law

In the event of disputes, German law shall apply exclusively. If the participant is a consumer, this choice of law shall apply only to the extent that it does not deprive the consumer of the protection afforded by mandatory statutory provisions or case law in the country where the customer has his or her domicile or habitual residence. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

The place of jurisdiction shall be the registered office of Kolibri360, provided that the participant is a merchant.

If the participant does not have a general place of jurisdiction in Germany, or if the participant moves abroad after participating, the registered office of Kolibri360 shall also be agreed upon as the place of jurisdiction.
